Fossick — Terms of Service
By creating an account or using Fossick (“the Software”), you agree to these Terms. If you do not agree, do not create an account or use the Software.
1. The Software
Fossick is a desktop application that builds a local search index of documents you choose and lets you search them. Indexing and search run entirely on your own device. Your documents and their contents are never uploaded to us or any third party (see the Privacy Policy).
2. Accounts
You must provide a valid email address and choose a password. You are responsible for keeping your credentials secure and for all activity under your account. You must be at least 16 years old (or the age of digital consent in your jurisdiction).
3. Purchase, billing & refunds
Beta period: while Fossick is in beta, access to search and indexing is provided free of charge to registered accounts — no purchase is required and no payment details are collected. Free beta access is provided "as is" for the duration of the beta and does not include any entitlement to continued free access after the beta ends. The remainder of this section applies to licences bought while paid licensing is in effect.
Access to search and indexing requires a licence, bought through our payment processor (Stripe) as a subscription (US$12.99/month or US$109/year) or a one-time lifetime purchase (US$199). Subscriptions renew automatically until cancelled; you can cancel at any time from the app or the billing portal, and you keep access until the end of the period you have already paid for — payments for started periods are not refunded. The lifetime licence is charged once, has no recurring charges, and includes software updates. 14-day money-back guarantee (lifetime licence): if Fossick is not for you, email getfossick@gmail.com within 14 days of a lifetime purchase and we will refund you in full. Otherwise payments are final, except where a refund is required by law, including the consumer guarantees under the Australian Consumer Law, which cannot be excluded. If you bought an earlier Fossick subscription, it has been discontinued and converted to a lifetime licence at no charge.
4. Licence & acceptable use
We grant you a personal, non-exclusive, non-transferable licence to use the Software for as long as you like — it does not expire or renew. You agree not to: reverse-engineer, resell, or redistribute the Software; circumvent the licensing checks; or use it for any unlawful purpose or on content you do not have the right to process.
5. Your content
You retain all rights to your documents. Because processing is local, we never receive, store, or have access to your document contents.
6. Disclaimer of warranties
The Software is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that search results will be complete or accurate, or that the Software will be uninterrupted or error-free.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of the Software. Our total liability for any claim is limited to the amount you paid in the 3 months before the claim. Nothing here limits rights that cannot be excluded under applicable consumer law, including the Australian Consumer Law.
8. Changes
We may update the Software and these Terms. Material changes will be reflected by a new version date above; continued use after a change means you accept the updated Terms.
9. Termination
We may suspend or terminate accounts that breach these Terms. You may stop using the Software and delete your account at any time.
10. Governing law
These Terms are governed by the laws of Queensland, Australia, and disputes are subject to the courts of that jurisdiction.
